Description

After nearly 12 years of debate, drafting and redrafting, a new Work Health and Safety Act 2019 will soon apply in Western Australia. The proposed legislation, which is currently in its final phase before Parliament, will become the primary safety legislation once enacted, replacing the existing Occupational Safety and Health Act 1984 (WA) and various other safety legislation (eg. the Mines Safety and Inspection Act 1994).
 
The new legislation has a number of notable differences from the current safety regime in Western Australia, including:
  1. The introduction of the broader coverage of “Persons Conducting a Business or Undertaking” to replace the current narrow term of “employer”.
  2. The requirement of a specific due diligence responsibility for “officers” of organisations (which would include schools) to demonstrate a proactive approach to workplace health and safety matters.
  3. Inclusion of the new offence of industrial manslaughter.
  4. Further increases in penalties for breaches of the legislation.
With such significant changes just around the corner, Lavan’s Education and Employment team will provide a pragmatic information session about the proposed legislation,  a review of the background to the new legislation, discussion about the notable changes from the current legislative process and consideration of examples from other states where similar legislation is already in place. 
 
The focus of the interactive session will be on the practical application of the new requirements as they apply to schools, including consideration of what is required to be done as part of the due diligence by an “officer” to assist schools to respond their new compliance obligations.
